Definitions
Customer: any professional or natural person with legal capacity within the meaning of Articles 1123 et seq. of the Civil Code, or any legal entity, who visits the Website covered by these Termsand Conditions.
Services: DYNERGIE provides Customers with:
Content: All elements comprising the information available on the Site, including text, images, and videos.
Customer Information: Hereinafter referred to as “Information,” which refers to all personal data that DYNERGIE may hold for the purposes of managing your account, managing customer relations, and for analytical and statistical purposes.
User: A person who logs in and uses the aforementioned website.
Personal information: “Information that, in any form whatsoever, directly or indirectly, allows for the identification of the natural persons to whom it relates” (Article 4 of Law No. 78-17 of January 6, 1978).

2. Terms and Conditions for Use of the Website and Services Offered
The Site constitutes an intellectual work protected by the provisions of the Intellectual Property Code and applicable international regulations. The Customer may not, under any circumstances, reuse, transfer, or exploit for their own benefit any part or all of the elements or works contained on the Site.
Use of the DYNERGIE website implies full and unconditional acceptance of the terms and conditions of use described below. These terms and conditions of use may be modified or supplemented at any time; users of the DYNERGIE website are therefore encouraged to review them regularly.
This website is normally accessible to users at all times. However, DYNERGIE may decide to suspend access for technical maintenance purposes, in which case it will endeavor to notify users in advance of the dates and times of the maintenance. The DYNERGIE website is updated regularly by the responsible DYNERGIE representative. 4. Contractual restrictions on technical data
This website uses JavaScript technology. The website cannot be held liable for any property damage resulting from the use of the site. Furthermore, the user of the site agrees to access the site using up-to-date hardware that is free of viruses and a latest-generation browser that has been updated. The DYNERGIE website is hosted by a service provider within the European Union in accordance with the provisions of the General Data Protection Regulation (GDPR: No. 2016-679).
The goal is to provide a service that ensures the highest level of availability. The hosting provider guarantees the continuity of its service 24 hours a day, every day of the year. However, it reserves the right to interrupt the hosting service for the shortest possible periods, particularly for maintenance purposes, to improve its infrastructure, in the event of infrastructure failure, or if the Services generate traffic deemed abnormal.
DYNERGIE and the hosting provider shall not be held liable for any malfunction of the Internet, telephone lines, or computer and telephone equipment, particularly due to network congestion that prevents access to the server.
5. Intellectual Property and Counterfeiting
DYNERGIE owns the intellectual property rights and holds the rights to use all content accessible on the website, including text, images, graphics, logos, videos, icons, and sounds. Any reproduction, display, modification, publication, or adaptation of all or part of the website’s content, regardless of the means or method used, is prohibited without the prior written consent of DYNERGIE.
The DYNERGIE trademark, registered by DYNERGIE, which may appear on this website, is the exclusive property of DYNERGIE. Any use of this trademark is prohibited without the prior written consent of its owner. This website and its content are protected under the French Intellectual Property Code, in particular by copyright, design rights, and trademark law.
Any unauthorized use of the website or any of the elements it contains will be considered an infringement and will be prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the Intellectual Property Code.
6. Limitations of Liability
DYNERGIE acts as the publisher of the website. DYNERGIE is responsible for the quality and accuracy of the Content it publishes.
DYNERGIE shall not be held liable for any direct or indirect damage caused to the user’s equipment while accessing the DYNERGIE website, resulting either from the use of equipment that does not meet the specifications set forth in Section 4, or from the occurrence of a bug or incompatibility.
DYNERGIE shall also not be held liable for any consequential damages (such as, for example, loss of business or loss of opportunity) resulting from the use of the DYNERGIE website. Interactive spaces (such as the ability to ask questions in the contact section) are available to users. DYNERGIE reserves the right to remove, without prior notice, any content posted in this space that violates applicable French law, particularly provisions regarding data protection. 7. Management of Personal Data
The Customer is informed of the regulations governing marketing communications, the Law of June 21, 2014 on Confidence in the Digital Economy, the Data Protection Act of August 6, 2004, and the General Data Protection Regulation (GDPR: No. 2016-679).
7.1 Parties Responsible for Collecting Personal Data
For Personal Data collected in connection with the creation of the User’s personal account and the User’s browsing of the Site, the data controller is: Cyrill Laval.

As the controller of the data it collects, DYNERGIE is committed to complying with applicable legal provisions. In particular, it is the Client’s responsibility to establish the purposes of its data processing, to provide its prospects and customers—based on their consent—with complete information regarding the processing of their personal data, and to maintain a record of processing activities that accurately reflects the actual situation. Whenever DYNERGIE processes Personal Data, DYNERGIE takes all reasonable measures to ensure the accuracy and relevance of the Personal Data in light of the purposes for which DYNERGIE processes it.
7.2 Purpose of the collected data
DYNERGIE may process all or part of the data:
- To enable navigation on the Site and the management and tracking of products and services ordered by the user: login and usage data for the Site, billing information, order history, etc.
- To prevent and combat cybercrime (spamming, hacking, etc.): computer hardware used for browsing, IP address, password (hashed)

7.3 Right of access, rectification, and objection
In accordance with current European regulations, DYNERGIE users have the following rights:
- Right of access (Article 15 of the GDPR) and rectification (Article 16 of the GDPR), as well as the right to update and ensure the completeness of Users’ data; right to restrict processing or erase Users’ personal data (Article 17 of the GDPR), when such data is inaccurate, incomplete, ambiguous, outdated, or where the collection, use, disclosure, or retention of such data is prohibited
- Right to withdraw consent at any time (Article 13(2)(c) of the GDPR)
- Right to restrict the processing of User data (Article 18 of the GDPR)
- Right to object to the processing of User data (Article 21 of the GDPR)
- Right to data portability for data provided by Users, where such data is subject to automated processing based on their consent or on a contract (Article 20 of the GDPR)
- The right to determine what happens to a user’s data after their death and to choose whether DYNERGIE should disclose their data to a third party they have previously designated
As soon as DYNERGIE becomes aware of a User’s death and in the absence of instructions from the User, DYNERGIE undertakes to destroy the User’s data, unless retaining it is necessary for evidentiary purposes or to comply with a legal obligation.
If the User wishes to know how DYNERGIE uses their Personal Data, request that it be corrected, or object to its processing, the User may contact DYNERGIE in writing at the following address:

In this case, the User must specify the Personal Data that they would like DYNERGIE to correct, update, or delete, and must provide proof of identity by submitting a copy of a valid ID (such as an ID card or passport).
Requests to delete Personal Data will be subject to the legal obligations imposed on DYNERGIE, particularly with regard to the retention or archiving of documents. Finally, DYNERGIE Users may file a complaint with the supervisory authorities, including the CNIL (https://www.cnil.fr/fr/plaintes).
7.4 Non-disclosure of personal data
DYNERGIE shall not process, host, or transfer Customer Information collected about its customers to a country located outside the European Union or deemed “inadequate” by the European Commission without first informing the customer. However, DYNERGIE remains free to choose its technical and commercial subcontractors provided that they offer sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: No. 2016-679).
DYNERGIE is committed to taking all necessary precautions to ensure the security of the Information and, in particular, to prevent it from being disclosed to unauthorized persons. However, if DYNERGIE becomes aware of an incident that affects the integrity or confidentiality of the Customer’s Information, it must notify the Customer as soon as possible and inform the Customer of the corrective measures taken. Furthermore, DYNERGIE does not collect any “sensitive data.”
The User’s Personal Data may be processed by DYNERGIE subsidiaries and subcontractors (service providers) solely for the purposes set forth in this policy.
Within the scope of their respective responsibilities and for the purposes outlined above, the primary individuals who may have access to DYNERGIE User data are primarily our customer service representatives.
8. Incident Report
No matter how much effort is made, no method of transmission over the Internet or electronic storage is completely secure. We therefore cannot guarantee absolute security. If we become aware of a security breach, we will notify the affected users so that they can take appropriate action. Our incident reporting procedures take into account our legal obligations, whether at the national or European level. We are committed to fully informing our clients of all matters relating to the security of their accounts and to providing them with all the information necessary to help them meet their own regulatory reporting obligations.
No personal information about users of the DYNERGIE website is published without the user’s knowledge, exchanged, transferred, assigned, or sold in any form to third parties. Only in the event of a takeover of DYNERGIE and its rights would the transmission of such information to the potential acquirer be permitted; the acquirer would in turn be bound by the same obligation to protect and modify data with respect to users of the DYNERGIE website.

To ensure the security and confidentiality of Personal Data and Health Personal Data, DYNERGIE uses networks protected by standard security measures such as firewalls, pseudonymization, encryption, and passwords.

9. Hyperlinks, cookies, and web beacons
The DYNERGIE website contains a number of hyperlinks to other websites, which have been included with DYNERGIE’s permission. However, DYNERGIE is unable to verify the content of the websites accessed through these links and therefore assumes no liability in this regard.

9.1. "Cookies"
A “cookie” is a small data file sent to the User’s browser and stored on the User’s device (e.g., computer, smartphone) (hereinafter “Cookies”). In such cases, DYNERGIE disclaims all liability for any consequences arising from the impaired functioning of the Site and any services offered by DYNERGIE, resulting from (i) the User’s refusal of Cookies or (ii) DYNERGIE’s inability to store or access the Cookies necessary for their operation due to the User’s choice. Finally, by clicking on the social media icons for Twitter, Facebook, LinkedIn, and Google Plus displayed on the DYNERGIE website or in its mobile app—and provided the User has accepted the use of cookies by continuing to browse the DYNERGIE website or mobile app—Twitter, Facebook, LinkedIn, and Google Plus may also place cookies on your devices (computer, tablet, mobile phone).

9.2. Web beacon
DYNERGIE may occasionally use web beacons (also known as “tags,” or action tags, single-pixel GIFs, transparent GIFs, invisible GIFs, and one-by-one GIFs) and deploy them through a partner specializing in web analytics that may be located (and therefore store the corresponding information, including the User’s IP address) in a foreign country.
These tags are placed both in the online ads that allow users to access the Site and on the Site’s various pages.
This technology enables DYNERGIE to evaluate visitors’ responses to the Site and the effectiveness of its initiatives (for example, the number of times a page is viewed and the information accessed), as well as how Users interact with the Site.

10. Governing Law and Jurisdiction
Any dispute arising from the use of the website https://www.dynergie.eu shall be governed by French law. Except where prohibited by law, the competent courts of Lyon shall have exclusive jurisdiction.
